“Do one of several things: They can either detach the brace from the firearm and keep both and they can attach that brace to another one.

I am just waiting for another populated building to go up in flames because the ATF needs to show it is a butch agency and the braces will be the excuse to light the fire.

  1. Here is what I’ve been advising and have done myself, regarding this subject. Using the ATF 4999 worksheet score system, made sure the weight was at least 64 oz and less than 120 oz (w/unloaded mag and no accessories). Have a length between 12″ and 26″. Removed the stabilizing brace and standard 6.5″ buffer tube and replaced the tube with a Strike Force 5″ buffer tube (SKU:SI-AR-SPRE-SLICK) which classified it as not being designed to be fired from the shoulder and not based on a ‘known shoulder stock design and shortened the length of pull to under 10.5″. Finally, I took off the pop-up rifle type iron sights and installed a red dot sight.

    On the ATF 4999 score sheet, this set-up scores a zero. Then since there is ambiguity regarding state of existence of the removed brace, I took off the factory stock on my legal 16.5″-barrel AR-15 and installed the brace on it.

    I believe I’ve addressed all matters of legal concern and am now in compliance, unless the ATF continues to do more insane mental backflips, in which case I’ll do what is necessary to remain legal.

    On page 19 of the 35-page ATF Final Rule 2021R-08F it says this on the Rearward Attachment Page: “An AR-type pistol with a standard 6 to 6-1/2-inch buffer tube may not be designed and intended to be fired from the shoulder even if the buffer tube provides surface area that allows the firearm to be shoulder fired because it is required for the cycle of operations of the weapon.” — So, I went one step further and installed a 5″ butter tube system, which has a quick release sling mount on the end so the AR-9mm 10.5″ Barrel Pistol can be positioned at a 3 o’clock belt position acting as a holstered pistol.

    Stats: 83 oz w/unloaded mag and no accessories., 22 7/8″ total length, no rear surface area, no adjustability, non-stabilizing support design, length of pull is 8:3/4″ w’ 5″ buffer tube necessary for operation, all of which totals a zero on the ATF worksheet scoring system.

  2. Amazing how he frames everything in terms of taking on gangs, but gang members are routinely let off on firearm charges. Anyone paying attention knows the ATF won’t even look at gangs — they’ll go after paperwork violations.
