States rights, damn the federal government!!!

A few years ago California declared itself a sanctuary state for illegal immigrants.  California would not cooperate with federal law enforcement in enforcing immigration law.

The federal government never did what it should have done and curb stomped the fuck out of California and make it compliant with federal law.

Now that the future of abortion is being decided in the Supreme Court (the ultimate decision I doubt will be all that radical), California has once again decided to act like its own sovereign nation.

Gov. Gavin Newsom says California will be an abortion ‘sanctuary’ if Roe v. Wade is overturned

California Gov. Gavin Newsom said he planned for California to be a “sanctuary” for abortions if Roe v. Wade is overturned.

Speaking to the Associated Press, Newsom said he was aware that out-of-state patients are likely to flock to California if protections for abortion rights are rolled back.

“We’ll be a sanctuary,” Newsom told the AP. “We are looking at ways to support that inevitability and looking at ways to expand our protections.”

The group’s recommendations include asking California to increase its investment in abortion funds to alleviate the cost of medical services and make providers more easily accessible. They suggested creating and funding an “uncompensated care program” that essentially pays for lodging and care for out-of-state individuals seeking abortions.

So California tax payers will pay into a fund that will cover the housing, travel, and abortion costs for non-California residents to come to California for an abortion.

Unless they specifically raise taxes for this, the fungability of money means that in one was or another  federal tax dollars will contribute to this.

Also, I suspect California will cut all other restrictions on abortion and it will become a free-for-all.

California can’t deal with mass looting, retail theft that is causing businesses to close, a runaway homicide rate, the worst homelessness crisis in the country, but it will make sure every Red state pregnant person who doesn’t want to become a birthing person can have a free abortion.

I swear, by the end of 2022 California will be under strict vaccine passport travel restrictions limiting the free movement of everyone except for people looting or having an abortion.

I don’t understand why California thinks it can go rogue and the federal government refuses to reign it it.

If California does this it should lose all federal tax dollars. If they want to act like a sovereign nation, they can fund themselves completely.

  1. Before Roe v. Wade, each state made its own laws regarding abortion. Thus you could have an abortion in state A but walk across a magical line and it was illegal. Some of the “no abortion” states where starting to make “If you cross state lines to have an abortion where it is legal to have an abortion you are guilty of having an abortion”

    Thus a woman going from State B (Illegal) to State A (Legal) could be charged and found guilty of a crime under the laws of State B.

    Wit Roe v. Wade decided abortion before viability became legal through out the United States.

    IF Row v. Wade is overturned then for the most part nothing changes. I say “most part” because there are a few states that have “triggered laws” (my term) in place. These laws put some level of restriction on abortions but they are not in effect until such time as Roe v. Wade is overturned.

    For the state of California, since abortion is already legal at a state level it remains legal.

    Newsom’s statement is the same as saying “Abortions are currently legal in California. If Roe v. Wade is overturned abortions will remain legal in California. Come kill your unborn here if you want.”

    The question asked by Mississippi is “Should this be a state issue?” and the only place it can really go is “Yes/No it is a state issue” and if it is a state issue, then the federal legislature can then propose a bill to place federal restrictions on abortions. Note, they can propose “You can’t have an abortion after the 10th month and no state can make a law that lowers that number” Thus “restriction” can in fact mean “no limit”

    1. Therefore pretty much sums it up here – striking down R v. W doesn’t make it illegal, just negates it being a constitutional right nationwide, and sends this decision back to the states. So if Cali wants to be an abortion state, let ’em, its their choice. If they want to fund an industry where they cater to out-of-staters, also their choice. I hope they bankrupt themselves in the process. K.Kb hints at this, there will probably be all kinds of verbal and legal camouflage to use federal funding towards this. That’s where the battles will take place on this issue moving forward.

    Minnesota has a Minnesota State Supreme Court Ruling legalizing abortion, so if Roe v. Wade AND Casey are overturned, abortion would remain legal in MN until it is either overturned by the MN Supreme Court or by a MN Constitutional Amendment approved by the voters.

    I do not see a federal law being passed legalizing or criminalizing abortion nationwide. I also do not see any way to enforce a state criminal law banning abortion procedures performed in another state.

    I see the return to the 1960’s-1973 practice of women flying to another state like NY or CA for a week to “take care of a problem” by killing their baby. Knowing the evil of some abortion fanatics, I could even see some states legalizing infanticide under the guise of post birth abortions. “Make it comfortable while the Woman and her Doctor decide.” – Ralph Northam, Democrat Governor of Virginia.

    1. CBMTTek, the Dems have problems with the 2A in general as you know. Unlike abortion, the 2A is in the BOR, but that doesn’t stop them from shitting on it. No state should have to declare anything regarding the 2A…but these days I guess that has to occur to let leftists know that they can’t F around with the usual infringements.

    2. They only care about states’ rights when it comes out in their favour. It’s like dealing with women: I want equality when it benefits me but special treatment when equality is bad for me. Once you stop thinking that they are rational like us, the scales will fall from your eyes.

  4. This is symbolic foot stamping from petulant California liberals. As previous comments have stated, if Roe v Wade goes away, things will be status quo in California. It literally has no bearing on their abortion laws. None.

    One might have thought that when “Don’t ask, Don’t tell” was overturned things reverted back to what is was before. It did not.

    The same for R vs W.

    Those that pushed for the former fear the later will happen to theit cause.
