Fort Hood sergeant indicted for murder in 2020 death of Austin protester

First Cavalry Division Sgt. Daniel Perry, who shot and killed a protester at a Black Lives Matter protest in June 2020, in Austin, was released after a posting a $300,000 bond following his indictment Thursday in Travis County for murder and aggravated assault with a deadly weapon.

“Sgt. Perry will vigorously fight all of these charges,” Perry’s attorney, Clint Broden of Dallas, said after the indictment was handed up Thursday.

Garrett Foster, 28, was shot to death shortly before 10 p.m. July 25, 2020, at the corner of Congress Avenue and 4th Street in Austin after Perry, who was working as an Uber driver to earn extra money, turned from 4th Street onto Congress and encountered the protesters.

According to Perry, foster motioned for him to lower his window then raised his rifle to point it at Perry, while other protesters banged on his car.

An interview with Foster before the shooting implied that he was there to intimate others with his AK, saying they are “too big of a pussy” to do anything.”

 

I’m surprised that this shooting went this way.

I’m guessing it’s heavily political and probaby influenced by Biden winning and being in control of the DOJ.

It just goes to show you that even though you think it’s a good shoot and over, the judicial system can still get you quite a long time down the road.

  1. It would seem that it is fine for antifa/blm to brandish a firearm but not fine to defend yourself.
    I have to wonder how the DOJ expected him to respond to a rifle pointed directly at him in a dangerous “protest” with an angry crowd and no way to retreat without running down several “protesters “? It would appear to be a loose, loose situation.

  2. Made a statement that he was carrying the rifle to intimidate others. Then he pointed it at someone. (see pic below). That person then took it as the threat it was, and responded. I don’t see how this can result in a conviction, but it might. Even if it doesn’t, his life is ruined. The state has unlimited resources. The trial will cost half a million in legal fees, so even if successful, he will be bankrupt.

    This is why I have come to the conclusion that you are better off doing what Antifa does- wear a mask, and if you DO happen to be involved in a DGU, leave. Run. Far, far away. Then never talk about it. Ever.

    A YEAR and then they turn around and charge him. Unless the judge looks at the prosecutor, laughs at him, and circular files the whole thing with prejudice (never know, we might get lucky), it’s clear if you try to offer resistance to Antifa/BLM, you best not get caught.

  5. It took a year of grand jury shopping to get an indictment. The Travis DA is a bought and paid for Soros neo-commie in the mold of the San Fran marxist DA. He won’t prosecute “people of colour” because they have been so oppressed. He is in favor of no cash bail, let everyone out of jail and the marxists in Austin suck it up. That is the 4% that vote in local elections.

    1. I don’t think the governor can do that unless the gentleman is charged and convicted. Certainly that seemed to be the case with the McCloskys.

      Anybody know how a conviction might interact with his military service, even if he is pardoned?

      1. Are the pardon laws different for Texas state cases than for Federal ones? I’m old enough to remember that Ford gave Nixon a pre-emptive pardon.

  8. Soon (if we are not already there) it will be illegal to defend yourself from these people and groups. Even if they follow home you and openly state they will kill you.

    I have commented about this before. There will be a point where antifa will be live-streaming public executions; breaking into peoples homes to kill everyone inside and not only will nothing be done but those who oppose, resist or defend themselves will be destroyed in one way or another by the government. It will be at that point fully legal for antifa members to murder you but illegal for you to defend yourself from being murdered.

    1. People have stated that if the cops start stacking up to take guns, they will be met with guns. Ie come and take them.

      The idea being that cops want to come home alive. Being met with gunfire while attempting an unconstitutional act reduces the chances of that happening.

      When antifa starts public executions via home invasions there are going to be lots of bodies piling up. The first few defenders are going to be punished like this man and “Ken and Karen” and “The Kenosha Kid” but the message will get out and fewer and fewer will be volunteering to be part of that mob attacking armed resisters.

      See how the KKK reacted to armed blacks or the mob reacted to the rooftop Koreans.

      Yes, people will be destroyed defending themselves. Unfortunately that is a price you pay when at war.

      It was the prosecutor or county attorney, which in many locales is an elected office. Example: Frisco elected Chesa Boudin, the son of two Weatherman Underground Terrorists. NYC elected Cyrus Vance Jr., and NYS elected AG Letitia James, the people that are persecuting the Trumps while ignoring the Clinton Crime Family. Vance is also well known for prosecuting working poor with box cutters for “Knife Crimes.”

      Most of these pro criminal prosecutors and State Attorneys General were elected with money and ads from George Soros.

      Please pay attention to the down ballot elections.

        When was the last time you saw a DA roll up with body armor and an assault rifle and drag an innocent person away in chains?

        Never, that’s when. Don’t try to pretend that the jackbooted scumbags with badges are in any way innocent of this, or deserving of support from anyone who believes rights are a thing that exists.
