Senators Kamala Harris (D-Calif.), Tim Scott (R-S.C.), and Cory Booker (D-N.J.) have introduced a bill that would make lynching a federal hate crime punishable by a sentence of up to life in prison. The bill is called the Justice for Victims of Lynching Act of 2018.
The first anti-lynching bill was introduced to Congress in 1918 by Rep. Leonidas Dyer (R-Mo.). It was passed by the House but Democratic senators from southern states failed to pass it in the Senate.

“‘Whoever willfully, acting as part of any collection of people, assembled for the purpose and with the intention of engaging in conduct described in paragraph (1) or (2)(A) of section 249(a) against any person, causes death to any person, shall be imprisoned for any term of 20 years or for life, fined under this title, or both.’’

Another bill that is heading to the waste basket.  And it is not because there are a bunch of Democrat Klan Members in the House or Senate, but because you cannot make a law so general and wide-reaching that you end up charging the people watching with a federal capital offense.

But I am going to make the assumption our solons knew this and are only pushing it because it will fail and they can make racial hay out of it. Plus the fact that murder is already very illegal in all 50 states.

  1. I figure somebody realized that while this law was created to stop Right Wing bogey men, it’s going to hurt radical Leftists.

    The UK created hate speech laws to stop the Right Wing and found itself prosecuting radical Muslims for advocating terrorism.

  2. So for a crime (Premeditated murder) that should receive the death penalty, if it’s motivated by “hate” then life imprisonment is appropriate?

    I fail to understand how adding a hate crime enhancement to any violent crime will deter the original crime. Weather motivated by hate, greed or indifference, the crime should be punished, not the motive.

    1. The whole notion of “hate crime” is blatantly unconstitutional. It criminalizes opinion, as opposed to action. That’s likely why the left likes the idea — after all, they hate the 1st Amendment and prefer to outlaw all opinions they don’t approve of.
