NRA v. Vullo

Today, the Supreme Court issued their opinion regarding New York’s lawfare attack on the NRA.

For the reasons discussed above, the Court holds that the NRA plausibly alleged that Vullo violated the First Amendment by coercing DFS-regulated entities to terminate their business relationships with the NRA in order to punish or suppress the NRA’s advocacy.

The judgment of the U. S. Court of Appeals for the Second Circuit is vacated, and the case remanded for further proceedings consistent with this opinion.
National Rifle Association of America v. Vullo, No. 22-842, slip op. at 20 (May 30, 2024) Justice Sotomayer

This is a 9-0 opinion. Justice Jackson wrote a concurrence, as did Justice Gorsuch.

Unfortunately, and expected, Justice Jackson tries to lessen the power of this opinion.

The lesson of Bantam Books is that “a government official cannot do indirectly what she is barred from doing directly.” Ante, at 11. That case does not hold that government coercion alone violates the First Amendment. And recognizing the distinction between government coercion and a First Amendment violation is important because our democracy can function only if the government can effectively enforce the rules embodied in legislation; by its nature, such enforcement often involves coercion in the form of legal sanctions. The existence of an allegation of government coercion of a third party thus merely invites, rather than answers, the question whether that coercion indirectly worked a violation of the plaintiff’s First Amendment rights.
id. at 2 Justice Jackson, concurring.

This is likely the entire reason for her writing a separate concurrence. Having quoted the majority opinion, [the state] cannot do indirectly what [it] is barred from doing directly., she goes on to say how critical it is that the government has the power and authority to do what it wants.

Indeed, she again forgets that we are a republic, not a democracy.

This is a good opinion.

Of course, it was the Second Circuit court that found that the NRA was wrong. They seem to have made that decision when they read the parties names.

I hate gun culture 2.0+ so much

There is a trend in the gun community that I fucking loathe with a burning passion.

The celebration of gun e-thots.

I grew up watching Shooting USA on Saturday mornings with my dad.

I was inspired by guys like Tom Knapp, Jerry Miculek, and Bob Munden. I loved the exhibition shooters.

Today, what I get hit with on YouTube and Twitter is shit like this.

She is an OnlyFans internet porn star who also likes guns.

She doesn’t shoot well. She turns ammo into recoil that makes her jiggle.

Then she posts just dangerous as fuck stunts like this.

Her head is downrange of the muzzle and in the way of the muzzle blast without adequate hearing protection. But it’s sexy, so it gets millions of views and is monetized.

Gun culture should be disgusted by this, instead it’s cheered on by the tactical gun-bro crowd.

Call me a boomer Fudd all you want, but if this is the new gun culture, I want nothing to do with it.

What is happening in North Carolina

This story is weird…

More from Stars and Stripes:

Special ops soldier under investigation in fatal shooting of Chechen man in North Carolina

An Army special operations soldier who fatally shot a man outside his North Carolina home earlier this month has not been charged with a crime amid an ongoing investigation, Army and law enforcement officials said Tuesday.

The soldier shot 35-year-old Ramzan Daraev at about 8:15 p.m. on May 3 after reporting a trespasser on the property in Carthage, N.C., according to the Moore County Sheriff’s Department. Deputies responding to the call found Daraev, a native of Chechnya in Russia, dead of multiple gunshot wounds, according to sheriff’s department officials

Sheriff’s deputies were told Daraev was a subcontractor for a local utility company and was working on that job when he was confronted and killed. The sheriff’s department said it was still working Tuesday to confirm Daraev’s employment status.

Daraev’s body was found by deputies about 250 yards from the road near a power line on the soldier’s property. He did not have any identification on his body, nor was he wearing utility company clothing or in possession of utility equipment or tools, according to the sheriff’s office. Family members and “an international identification” found in his vehicle were used to identify Daraev, sheriff’s officials said.

After the shooting, Moore County deputies called in an FBI special agent who supplied a translator to speak to others who claimed to be Daraev’s coworkers. An FBI spokesperson said the bureau was not currently involved in the investigation.

Honestly, thos whole things sounds like it could be the opening episode of a new season of Jack Ryan.

It’s not ridiculous to think this may have been an enemy operative scouting as a prelude to an aggressive act against the United States.

We’ve shown consistent weakness on both immigration security and confronting foreign countries, so why wouldn’t they be more active in fucking with us on our home soil.

Whatever this is, it feels bad.

Another Tool!

At this point, I have more tools than I have toolholders. This can be frustrating as I like to have “standard” tools ready to go.

Just as an example:

  • Four different shapes of right hand turning tools
  • Chamfering tool
  • Parting tool
  • Shearing tool
  • Facing tool (left hand)
  • Grooving tool
  • Right hand threading tool
  • 3/8″ Boring bar
  • 1/2″ Boring Bar
  • 3/4″ Boring Bar
  • 5/8″ Grooving bar
  • Right Hand threading bar
  • Left Hand threading bar

These are tools that live in toolholders ready to be used.  I would have more in toolholders if I had more toolholders.

Aloris BXA#1 can be had for the low, low price of $83.  The #2, which has a grove for boring bars, is only $82+shipping.

Then there is the shop made version:

BXA for 1/2″ square shank tools

I have two more that are ready to finish to this stage.  Once those two are completed, all three are going into the mill for some aggressive chamfering.

When that is completed, they three of them will be hot blued, oiled, hardware installed, and then they will be ready to go into production.

I have the raw materials for another 6 toolholders.  I have some smaller tools, 1/4″ I think.  I plan to make a couple of 1/4″ toolholders.  Three more will be 5/8 and one will be 3/4.

The nice thing, is that having done this once, the next time becomes much easier.

“Video of Florida police officers punching teen sparks outrage” (But only if you shade the facts)

“ZOMG! The poor young baby being abused!”

I love the way they blur the teen to “protect” him from… something or other. You can almost only see the cops raining punches and taser on him and he not relenting which should be the first hint something is not quite right with the slant of the story. Then I saw something it caught my attention: the size of the teen’s thigh. Holy crap, that does not go with a small gangly teen.
So, I looked for the unedited video and it was provided.

That is one big asshole. He is taller than the cops and easily outweighs each cop individually. He chose to resist, he lost.

I hope it is a lesson he learns.  But I doubt he will.

Don’t be this asshole – updated

That is a B&T APC9K PRO semi-automatic pistol with a brace.

It’s a 9mm with a 4.3 inch barrel.

That is not enough for large, tough, thick-skin game like boar, or even feral pigs.

Shooting animals, even nuisance ones, with the wrong gun is cruel and stupid.

But trust an internet celebrity idiot with more money than brains or decency to do shit like that online for monetized clout.

This asshole needs to lose his guns until he can be responsible with them.

Don’t be like him.

Update:

I found video of his hunt.

That’s not a hunt, that’s a drive-by killing.

It shouldn’t take that many rounds to drop an animal.

It shouldn’t have to be speared to put it out of its misery.

You shouldn’t hunt from a moving platforms (unless you are an absolute professional).

No ear protection, no eye protection, just cruelty.

Fuch this guy to the end of the earth and back again.
