47.3 percent of those convicted for federal gun crimes were black — a racial disparity larger than any other class of federal crimes, including drug crimes. In a 2011 report on mandatory minimum sentencing for gun crimes, the U.S. Sentencing Commission found that blacks were far more likely to be charged and convicted of federal gun crimes that carry mandatory minimum sentences.

  1. Obviously the solution is to amend the Affirmative Action program to allow black men charged with federal gun crimes to plead out or be sentenced to probation, and forbid whites, Hispanics, and Asians from accepting plea bargains or introducing exculpatory evidence.

    While we’re at it, we should raise the burden of proof required for blacks to “beyond ANY doubt” and lower it for everyone else to “Sumdood said it was that guy after I gave him 20 bucks.”

    THAT should bring the conviction and incarceration rates more in line with the population ratios!

  2. Less than 3,000 convictions nationwide? Why do I think there are over 3.000 illegal firearms uses that could be charged and convicted in Chicago alone every year? Why isn’t the federal government helping Chicago get the criminals off the streets, and into jails where they belong?

    Unless enforcing laws in Chicago, Barack’s hometown, the murder capital of the US, is racist?

  3. This is Radley Balko’s blog, The Watch. Balko is a libertarian, but I don’t get the impression he’s a gun guy. With that in mind, it’s not really much of a surpise to see a gun rights-leaning post there, any more than it is to see one on The Volokh Conspiracy, which was also recently picked up by WaPo.
