Some Serious BS from Illinois

The Illinois Council against Handgun Violence is out with a new ad that is 100% dishonest bullshit.

According to their website TeddyGun.com, toys are regulated and guns are not, and that’s not right.

So to be they try to make a point by being sardonic and make an unregulated toy by making into a gun.

Except they missed the whole point.  Either they are monumentally stupid.  Deliberately lying through their teeth.  Or both.

Both.

The only regulation they lost for guns is a Type 07 FFL.

That’s not a simple regulation to get.  Compliance is strict, trust me.  Going through an ATF audit, is like having a paperwork colonoscopy without anesthesia, and if they find a polyp, you go to prison.

It’s not just one simple regulation.

Then they go to Teddy Bears.  they start with ASTM testing.  ASTM simply sets testing standards.  They are not a legal regulatory body. There is an organization that sets the test standards for firearms.  I have helped write test standards for them.  It is called SAAMI – The Sporting Arms and Ammunition Manufacturers’ Institute.

Next, they go to to the Code of Federal Regulations for toys.  Many can be found here.

There is where this becomes true  disingenuous bullshit.  Guns and toys are different.

Guns are designed to kill.  That is what their indented use is.  Hunting, self defense, military, etc., guns kill.  That is no secret.  When a user points a gun at a living thing and pulls the trigger, the expectation is that the living thing will stop living thereafter.

That’s not the intent when it comes to a teddy bear.  You don’t hand a teddy bear to a child and expect it to die.  Quite the opposite.  There is an expectation that the teddy bear is safe to use.  It is not a killing machine.

So various regulatory bodies have set forth rules to establish how much force it takes to rip the eye off a stuffed toy to prevent a toddler from biting one off and choking on it.  Fire retardant standards have been established so that teddy bears don’t catch on fire.  Regulations against sharp corners, lead contamination, etc., all exist for safety reasons.

Nobody in their right mind would hand a loaded gun to a child to play with and expect a safe outcome.  Nobody expect to hand a teddy bear to a child and expect to toy to kill the child.

That is the difference.

That is not to say liability does not attach to guns.  It does, when they MALFUNCTION causing them to kill when the user does not intent for that to happen.  Such as in the lawsuit against Remington for the 700 trigger, which resulted in an eventual recall and settlement.

These people have been pushing the idea for a while that gun makers and gun dealers should be held liable for the MISUSE of their products.

This is a perversion of the law and common sense.

It makes me hope the next time somebody is killed with a baseball bat during a home invasion, the family of the deceased sues the shit out of Wilson Sporting Goods.

Ultimately, this reflects on the whole mentality of the Liberal anti.  They hate guns and love regulations and want nothing more than to eat away at gun rights with regulations.

The irony here is, I’m pretty sure that if they really made a teddy gun, hoping to avoid regulations, they illegally manufactured an illegal Title II AOW “disguised firearm” and committed a felony.

Idea for California

California Governor Jerry Brown is considered to be the leading elected official going after climate change.

He just signed into law a bill adding 12 cents more tax to gasoline in California, bringing the total per gallon tax burden to 30 cents.

I think this is a terrible idea, 12 cents is NOT NEARLY ENOUGH.

Let’s look at New York, and New York City in particular.

NYC has the highest cigarette taxes in the country.  New Yorkers pay $4.35 in state taxes, $1.50 in NYC tax, and 8% in sales tax, making the average cost per pack about $10.60 in 2105.  The average cost of a pack of cigarettes in the US today is $5.51 and in NYC is $12.85, meaning that New Yorkers pay a tax rate of about 133% on cigarettes.

Consequently, the smoking rate in New York is at the lowest in recorded history.

Way to go New York.

I think if California was really serious about climate change, it would treat gas the way New York treats cigarettes.

The average cost of a gallon of gas in the US is about $2.40.  I believe California should raise that by 133% to $5.60.  With this plan implemented, petroleum use in California should drop to record lows.

California has a labor participation rate of 62%, so at least 38% of the adults in the state don’t need to drive to work on a regular basis.  The rest can take public transportation.

Just think how cutting edge California will be for combating climate change.

 

It’s just stuff – followup

There were a few comments to my post It’s just stuff, including a few emailed to me that I can summarize as: “My stuff is valuable and I’m going to defend it.”

I’m not a lawyer so I’m not going to give you legal advice.  I’m not going to even tell you what you should and should not do.

I can only give you my opinion.

The Progressive Left is on the warpath.  They’ve been losing politically so are engaging in their own Operation Luttich on the social front.  It is taking the form of protests, marches, hashtag campaigns, doxing, public shaming, a judge wearing a pussy hat while seated on the bench in court, etc.

Nothing happens in a vacuum.

So… I’m in Bob’s spot.  I’m blocked in.  Some unhinged black SJW is taking out all her learned helplessness and victimhood on the most prized possession I have, parked on a trailer behind my pickup.

I come out guns a’blazing.

I can see the headlines now:

“White man kills black woman in the street for vandalizing his property.”

“Vandalism has a death sentence if you are black.”

“White man shoots #BlackLivesMatter acitvist for protesting his white privilege.”

It will be a Travyon Martin times 1,000,Three Ring Shit Show Bonfire of the Vanities.

Is it right?  Is it fair?  Is it just?

No, but it will happen.

Stay in the car and dial 911.

Throw the car into low and drive out the there.  Hop the curb and leave the trailer behind if I have to.

If I absolutely have to shoot, it better be above reproach.  That hammer is going be coming for my head when my bullet makes impact.

My goal is not just to survive.  It’s to survive, not go to prison, and hopefully not get crucified by the media, or sentenced to death in the court of public opinion.

The Devil A white man had the audacity to drive from Florida to his home in Massachusetts, with his wife.

He was driving a Porsche and hauling a boat.  The news didn’t say what kind of Porsche, but I’m going to guess a Cayenne, I don’t think anybody is going to haul a boat with a 911.

He stopped for gas in Caroline County, Virginia, where a presumed Bernie/#BLM supporter decided to opine on his materialistic white privilege… with a hammer.

“This lady was a couple pumps over and talking to me and yelling at somebody about having a message for her. I had no idea what she was talking about,” Bob said. “I was coming around the side of the car and next thing I know a car blocks me in. She comes out of her car gets in my face and yelling at me about some sort of message I got for her.”

He said he attempted to ignore her, but she eventually threatened to put a hole in his “fancy boat.” That’s when, Bob said, the woman grabbed a hammer.  “She actually took a hammer and she hit his vehicle and the boat,” Sheriff Lippa said.

“There were some racial slurs directed at her [Bob’s wife], at which time the accused spit in [Bob’s wife’s] face,” Sheriff Lippa said. “According to the victim, there were racial slurs that were yelled at [Bob’s wife] before [Jones] spit at her and that’s what we’re looking into as far as it being a hate crime.”

During the attack, the couple said the woman said she was “sick of fancy white people.”  

Bad situation.  I get that.

Here is where it gets worse.

“She actually clawed him. He took her down to the ground to prevent her from doing any more damage.”

“I let her go and she grabbed the hammer again and hit the boat again,” Bob said. “[The hammer] broke. That’s when she figured out she better get out of there because she didn’t have a weapon anymore.”

Crazy woman is beating up the guy’s SUV and boat with a hammer, and he decides he’s going to protect his stuff by wrestling her.

NO!  It’s just stuff.  She has a hammer.

I don’t know if it was dumb luck or God’s will, but what that woman picked the hammer back up, she went back to hitting the boat instead of hitting Bob in the skull.

Bob was risking death over some, probably well insured, stuff.

He didn’t come out looking to good from his wrestling match, either.

Bob is on his way to the hospital.

I have a $500 deductible on my car insurance and a $2500 deductible on my health insurance.

If I sat in my car and let a crazy woman wail on it with a hammer, I’m out $500.  If I get out of my car and take a whack to the face that requires an ER visit, I’m out at least $2500.  If I get out of my car and take a whack to the head with that hammer, my family is using my life insurance to bury me.

I’m gonna stay put in my car and call 911.

Actually, I drive a Chevy truck, so I’m going to ram the shit out of her car and make a getaway, but let’s assume that I’m blocked in.

If Crazy Woman tries to come through the window at me, that’s a different situation.  Now it’s $500 for the car and $25 for another box of Golden Saber.

Remember, if you get out and shoot her for only smashing your tail lights, it’s not a good shoot.  I don’t want to begin to do the math on how much a murder trial will cost.

Bob here didn’t do the math and took a risk to protect his stuff and paid a price in blood.  He’s lucky he’s not dead.  Of course, being from Massachusetts, he is guaranteed to be unarmed, making his options even more limited.  More reason to get back in his car and call 911 or try to flee.

Remember, it’s just stuff.  If can be replaced.  It’s not worth fighting an armed, violent person over something Geico will make whole again.  It’s cheaper and easier to fix a tail light than a skull.

 

There are Four Lights

I read Miguel’s post about the families of the victims of the Pulse shooting trying to sue Google, Facebook, and Twitter over ISIS recruitment.

Personally, I’d like nothing more than watching those liberal putz get sued, because while Facebook vows to fight Islamophobia, they are somewhat more tolerant of Antisemitism.  Progressivism is a hotbed of old fashion Jew hatred, even when the progressives are “Jewish” themselves.

But… Miguel does make a good point.  With these people safety is the justification for control.

“As we know by now, Gun Control is not about guns but about control. And people like Ms Leinonen have contempt not only for the Second Amendment but for the whole Bill of Rights.”

It reminded me of this article that I read in The Independent: People who read the news more likely to be Islamophobic, study finds.

Research from the incredibly tolerant state of New Zealand discovered that, regardless of political affiliation, the more news a person reads, the more they are likely to harbor negative feelings about Islam.

File that one in the “no shit” category.

Maybe it has something to do all the terrorist attacks, rapes, beheadings, stonings, gays thrown off rooftops, captured sex slaves, attempts at genocide, and other atrocities committed by Muslims in their homelands AND in the Western World.

The conclusion that the Kiwi researchers came to is, unsurprisingly, censor the news.

Though un-making prejudice is difficult, we hope these results challenge the media to present fairer representations of Muslims.

I already covered how a bunch of progressive comic book authors, published a piece of  propaganda that would make Viktor Deni proud, rewriting the pulse shooting to be more of an act by a Dylann Roof copycat than a “Allah Akbar” screaming acolyte of ISIS.

It is quite obvious that Progressives read Orwell’s 1984 as a how to manual.  I am afraid the next step in the War on Terrorism Islamophobia is to make the victims of terrorism in the West, Soviet Style unpersons.  Western victims of terrorism will just be disappeared.  Causes of death will not be mentioned.  Families will not be allowed to talk about lost loved ones.  Memorials will be banned.

It will be like a less funny, more Kafkaesque, Men In Black cover up.  If these people weren’t killed by Islamic terrorists, then there is no reason for Islamophobia.

I know that sounds like an episode of The Twilight Zone, but nothing going on in Europe or Liberal America makes any sense to a rational person right now.

The Washington Post published an article, explaining in a very simple and straightforward way, why under no circumstances, will Hillary Clinton be able to replace Donald Trump as president within the time frame of the current administration.

Sorry, Democrats. Trump’s not going anywhere. You wouldn’t like who would follow anyway.

In a nutshell: The Constitution.
In typical Democrat fashion, liberal commenters showed just how much regard they have for the rule of law and founding document of this nation.
Then I saw this in the WaPo author’s timeline.
Civil War.  If they don’t get Hillary, they are going to start a civil war, and they think they will win it.
I get that sure, some Liberals are buying guns,  but I still don’t think there is enough of them to make an effective army.  But they can fantasize , right?  Yes they do, and they fantasize about killing other Americans.
Actually, reading this, if the Left wants to break away from the US, form their own People’s Republic of America, and appoint Hillary Clinton President Regina for Life, I want them to too.
The political pendulum in America is always swinging.  We got Obama, then we got Trump.  It will swing back one day.  If there is one thing I know about Progressives/Liberals/Leftists, when they daydream, they day dream about Genocide.  They fantasize about death camps for those who disagree with them.  The Soviet Union, NAZI Germany, Fascist Italy, Maoist China, North Vietnam, North Korea, Cuba, etc., the list goes on.
I know that the next Democrat elected will do so with the promise of making Trump supporters pay, and pay dearly.  It will be a campaign entirely based  on Democrat vengeance.  I don’t want to see that.  If they want to go their own way now, and rule their own country, and leave us who didn’t support Hillary alone, I’ll take that.  I have a feeling it is better than what will come after Trump.

Wagoner County Holy Trinity

Miguel has covered this ongoing story in previous posts.

Let’s go over the details again:

Three teens broke in a home through the back door with the intent to burglarize it.

The son of the home owner opened fire with an AR-15 and killed all three home invaders.

It was determined by police that one teen had been armed with a knife, another with a pair of brass knuckles.

As per Oklahoma Title 21 § 1272 Unlawful Carry (see bold)

It shall be unlawful for any person to carry upon or about his or her person, or in a purse or other container belonging to the person, any pistol, revolver, shotgun or rifle whether loaded or unloaded or any dagger, bowie knife, dirk knife, switchblade knife, sword cane, knife having a blade which opens automatically by hand pressure applied to a button, spring, or other device in the handle of the knife, blackjack, loaded cane, billy, hand chain, metal knuckles, or any other offensive weapon, whether such weapon be concealed or unconcealed, except this section shall not prohibit:

(Paraphrasing) law enforcement, hunting , licensed CCW, historical reenactment, etc.

The getaway driver admitted to being part of the break-in, they they didn’t know the shooter, and chose the house because it seemed like a promising payday.

After waiving her right to an attorney, Elizabeth Marie Rodriguez, 21, told investigators Wednesday that “she did not know Zach Peters,” but said she “indirectly became aware of Peters’ father.”

“She said she determined Peters had money and expensive belongings, and that was why she selected his home, to ‘hit a lick,'” Mahoney said.  “Hit a lick,” Mahoney explained, “is a term some criminals use to describe getting a significant amount of money in a short period of time.”

Rodriguez turned herself in to authorities shortly following the home invasion and shooting. She stated to investigators that she “planned the robbery and drove the vehicle,” Mahoney said.

Rodriguez, the getaway driver, knew the homeowner, even using his first name, and planned the burglary, apparently aware that the house contained valuable items.

She admitted that the group had broken into homes before in the Tulsa area, and were responsible for other burglaries.

The teens were dressed in all black and were wearing masks and gloves, concealing their identities.

At this point, everything is pointing to a good shoot.  Three people, armed, and concealing their identities, broke into a house.  The person occupying the home at the time was scared and opened fire with a legally possessed firearm, killing the perpetrators.

You’d think that with this orgy of evidence, the people associated with the break-in should just keep their heads down and try not associate themselves with this crime spree.

You’d think.  But the desire to claim victim status is just too much for some people to resist.

Family member of teen burglary suspect killed in Wagoner County break-in speaks out – KTUL

The grandfather of Jacob Redfern took his grief to the cameras.

“What these three boys did was stupid,” said Leroy Schumacher.

Schumacher agrees his grandson and his friends made a bad decision, but not one worthy of deadly consequences.

“They knew they could be punished for it but they did not deserve to die,” said Schumacher.

Ah yes, the “stupid teenager” defense.

Grandpa then doubles down on his stupidity.

Schumacher says his grandson didn’t have a chance. The 17-year old, he says, never got into trouble.

“Brass knuckles against an AR-15, come on, who was afraid for their life,” said Schumacher.

I guess Grandpa thinks that brass knuckles rank in lethality somewhere between a wiffle bat and a NERF gun.

One punch killings are fairly common.  Add in the additional mass and hardness of a pair of brass knuckles and they are definitely a lethal weapon (examples 1, 2, 3) .

This is a video of some idiot using a pair of brass knuckles to kill a spider.

Imagine that drywall being some skull.  Now the impact force of a pair of brass knuckles starts to make sense.

So to answers grandpa’s question, I’m pretty sure the  homeowner, seeing three people in masks, armed with a knife and brass knuckles had every right to be afraid for his life.

The homeowner’s son has not been charged with a crime. Deputies believe he fired in self-defense.

“There’s got to be a limit to that law, I mean he shot all three of them; there was no need for that,” said Schumacher.

Who should have the homeowner’s son shot?  Just the kid with the knife?  Brass knuckles are also a lethal weapon, seems like the shooting of his grandson was pretty justified.  Considering that at least two of the three invaders were armed, it seems that their intent to do harm to any occupant of the house was obvious.  I’d argue that shooting all three was pretty necessary.

Schumacher does say he supports the right to bear arms and protect your home. But he doesn’t agree with shooting and killing intruders.

Then why support the RTKBA?

“These boys’ families are going to suffer with this the rest of their lives, we have to live with this the rest of our lives,” said Schumacher.
And if his grandson and his idiot friends killed Zach Peters during the home invasion, how would the Peters family feel?  I guess grandpa doesn’t care about the family of the intended victim.
It’s a situation he knows was caused by the three teens’ poor decisions. He only hopes their deaths can be an example for others.

“You can’t change history, but you can damn sure learn from it, and maybe some kids will learn from this,” said Schumacher.

Yes kids.  Learn from this.  Don’t break into people’s houses and try to steal their stuff.

I thought that grandpa’s attempt at becoming the next Sybrina Fulton was bad enough.

I was wrong.  There was a candlelight vigil for the three teens killed.

No official organizers for the vigil were named, however, I have a feeling that it was not an organic event.  I suspect that some people aligned with Social Justice are trying to make hay out of this, but it doesn’t seem to be catching on.

Despite the large crowd at the vigil, no one was willing to talk on camera.

Several, telling us off-camera that it’s awkward because of the teen’s involvement in the crime.

It’s really hard to publicly mourn three teens that all evidence points to them braking into a house to kill and rob the homeowner.

Also, the vigil didn’t end well.

About an hour into the vigil, someone was heard yelling that someone had a gun.

People scattered and police converged on the scene, along with an ambulance.

“Everything was cool, going alright. The, kinda, ring leader of the whole situation took off, came back screaming said, ‘Everybody get down, everybody run, run,’ this and that. No shots were fired but, ya know, everybody was scared just like it happened,” said witness Matthew Anderson.

I have a feeling that this case isn’t going to go away anytime soon.

Treyvon Martin’s mother parlayed the shooting of her son into a lucrative foundation, a book deal, and perhaps even a run for public office.

Losing a family member to a gun owner in a criminal act can be a windfall, if you play your cards right.  In this case we have three teens dead and the shooter defending himself used the dreaded AR-15.

The rub is, the kids were white and so was the shooter.  There is no racial tension here to play off of.  I don’t think that is enough to kill this, but it is a hurdle the Social Justice victim-mongers will have to overcome.

Time will tell.
