Mesa PD Shooting: Bad procedure is not criminally breaking the law.

MURDERER GOES FREE! was pretty much the headline I saw yesterday about the shooting of Daniel Shaver. The very much edited version of the video I saw did not explain much nor the articles accompanying the video. But one thing it called my attention immediately was that we had one officer responding to a call with a long gun. And that Ladies and gents told me that this was not a hotel manager calling the cop simple noise complain and eviction.

It was not till this morning that I caught Donut Operator’s video and explanation. Watch it all and I shall continue after.

Not quite the same stuff you read in most places, is it? And I have to say this: you shove your arm behind your back and it is going to be interpreted as you about to reach for a firearm. I know, was in a similar situation and it was reacting or finding out if there was a gun. And sorry but  I am not giving you the benefit of the doubt with my life at stake.

Was it a bad procedure? Yes. it was a cluster fuck and in hindsight,  things could have been done differently. But Bad procedure in this case does not mean it carries the same weight as breaking the law. For all we know that procedure has been used thousands of times before by Mesa PD without negative results. They were riding on luck till the tank hit empty and somebody got killed.

As for a civil case, I haven’t investigated if one was done, but I figure the family has a better chance there. IANAL but bad procedure can be used against the department in a lawsuit.

This was an enormous shit sandwich with some people taking a bigger bite than others.

A man is dead after police say a father shot and killed him for threatening his family inside a Popeye’s Chicken restaurant in San Antonio.
Police say the robber approached the father around 8:30 Wednesday night while he was waiting for his kids to leave the bathroom.
That’s when the robber pointed his gun at the family.
The father pulled out his own gun and killed the robber in the middle of the dining area.
Police say the father is a licensed carrier. He is not facing any charges.
Officials also say the father saved several lives.

Liberals love parsing language to create a “favorable” mood to their cause rather than tell the facts. That would explain why the herd of sexual predators got away with so much shit as it was not sexual assaults but friendly taps and hugs.

The again, since the father was a concealed carrier and National Reciprocity is on the news, there is no way in hell Traditional media is going to give example on how well it actually works and rather go with “Blood on the streets” and “Armed Felons across State lines.”

Franken resigns and the media clings to one thing.

I, of all people, am aware that there is some irony in the fact that I am leaving while a man who has bragged on tape about his history of sexual assault sits in the Oval Office, and a man who has repeatedly preyed on young girls campaigns for the Senate with the full support of his party.

Pundits are going “ZOMG a parting shot against the Republicans! They are doomed if Moore does not resign and Trump is impeached.” However there is something at the beginning of his speech that caught my attention:

I can imagine the pressure the party put on him after Conyers resigned. I can hear the Special Interest screaming how come the black guy had to resign and the goofy looking white boy gets to stay. And make no mistake, Part of Franken’s colorectal exploration and removal by his party is based on racial politics.

Never forget they are scum

U.S. Rep. Ileana Ros-Lehtinen (R) voted NO on National Reciprocity. She was one of a handful of RINOS that went against her own citizens, for reasons unknown. She is retiring and I guess somebody must have approached her with promises of a cute and rewarding life outside politics to make her vote the way she did.

But what makes her special is that during almost all her years in congress, she got the votes of South Florida Gun Owners. Her timing was impeccable: she got elected for the first time after the AWB when the tide turned against gun control and she was smart enough to ride the wave without having to go too deep into the wave.

I was fooled as much as anybody else, specially since there was a mutual acquaintance that worked closely for her and was also involved in the South Florida gun culture and there was even campaigning for her from gun people. The only good thing is that she was not in my district so I did not waste either time or money on her.

Some years ago, a local public range where we shoot regularly was in dire need of reconditioning and remodeling so we ask her help to find funding and help rebuild the place. The shooters that did the most noise and lobbying with the local government where the action shooting clubs and the shooting schools. We only wanted three miserable bays for shooting o the move and the place had more than enough available land so Long Range Shooters, Sporting Clay enthusiasts and regular folk could enjoy their particular predilection without stepping on each other’s bags.

So the  money was found, a design agreed on and the range was closed for months so it could be upgraded. Finally came the day to be re-opened and we were even asked to give a demonstration of what IDPA was about. Much to our surprise, every single discipline had now a very nice and upgraded range… except action shooting and the schools.  We got fucked at both levels of government.

Oh, we were promised that for sure at the next budget meeting, monies would be available for the bays, and not to fret. That was over 5 years ago IIRC and the bays are still MIA.

That day I figured out Ros-Lehtinen was a lying sack of shit politician, (but I repeat myself) and made clear I did not want to do shit with her and so were many of my fellow shooters, some louder than others. I know the effort that some people put into getting those three bays and it pissed me off that they got nothing but fucking aggravation and sore asses for their work.

So i do hope Ms. Ros-Lehtinen finds karma on her civilian life and that I can do a Schadenfreude report sometime in the near future.

Felon with Gun or Felon with Bacon, Who is the Worst?

Here is the tale of two felons:

A man who vandalized a Central Florida mosque by smashing windows and lights with a machete and leaving bacon at the scene pleaded guilty to criminal mischief to a place of worship.

The state attorney’s office serving Brevard and Seminole counties said Michael Wolfe was sentenced to 15 years in prison followed by 15 years of probation after he pleaded guilty Tuesday. The sentence had a hate crime enhancement.

He is a career criminal with 2 felony convictions for burglary, possession of burglary tools and grand theft. No violence in his history that I could find.

Now let’s meet our second contestant:

Miami-Dade police officer Manuel Gonzalez was taken to Jackson Memorial Hospital in a patrol car and limped into the emergency room on his own while accompanied by two Miami-Dade Fire Rescue workers.

He was in stable condition after suffering “multiple” gunshot wounds, police said. Gonzalez, a seven-year veteran who is married and has two young children, is expected to survive.

The suspect, a convicted murderer named David Facen, 54, lay dead and covered by a yellow tarp between two vehicles in the Walmart parking lot, several hundred feet from the store’s entrance.

Now Mr. Facen is also a career criminal but a tad different: He served 20 years for Second Degree Murder, possession of a firearm by felon and selling drugs near school. After that he was sentenced to 15 years for carrying a concealed firearm by a felon/Violent Criminal in possession of a gun and battery to LEO/Firefighter/EMT. He should be still in prison for those crimes, but he was given “community supervision (parole) after only 2 years, 2 months and 30 days.

So now you know, boys and girls: Legal bacon in Florida carries a bigger consequences than a felon carrying a firearm.

That is some screwed up law system right there.
