Semi-retired like Vito Corleone before the heart attack. Consiglieri to J.Kb and AWA. I lived in a Gun Control Paradise: It sucked and got people killed. I do believe that Freedom scares the political elites.

  1. I think we’re going to see a lot of these in the coming year, and the left will use them to push for more restrictive regulation, while everyday people start to realize that gun control just plain doesn’t work.

  2. He didn’t even buy the gun in Tennessee. He got the gun in Illinois and it was taken and given to his dad who gave it back to him illegally. So what that TN didn’t know. What were they going to do to stop him from crossing into state lines with it?

    1. Vehicle (and body cavity*) searches at the border. After all, why should that pesky 4th Amendment stand in the way of the Brady crew’s totalitarian fantasies?

*Yes, I know that it would be rather difficult to transport an AR-15 in one’s body cavities, but It’s For The Children [TM].

  3. Dose losing your FOID card in Ill make you a prohibited person in every state?
I don’t know the status of this guy from the federal standpoint.
Another question is, does not being able to pass a NICS check mean you are prohibited from owning a firearm or just from purchasing one from an FFL?

  4. Did the dad give it back illegally? It takes nothing to yank an IL FOID card. No due process required. So they did. Was there any due process beyond that?

Now, don’t get me wrong… The guy had due process prohibited person written all over him. I just jave the feeling the Man decide taking the card in one state was enough and couldn’t be bothered to keep going

    1. I live close enough to where this happened that the helicopters woke me up. As such, local media has been covering this CONSTANTLY and INCESSANTLY since Sunday. That is a lot of time to fill, so they’ve been reporting a lot more than they normally would.

It does appear that the father admitted to the FBI that he illegally (in Illinois) gave his son the firearms back while both were in IL. So we have the “illegally gotten from a family member loophole” which isnt really a loophole at all since its illegal. :/

All of his arrests and whatnot happened outside of TN. Tennessee does not participate in NICS, but that doesn’t matter because he didn’t buy any weapons in Tennessee. He couldn’t, legally, because he did not have a TN Drivers License. We have a high rate of false-positives on background check failures because it’s set up as a sort of default-deny thing.

If you are arrested for something that might wind up as a felony jail sentence, that arrest is generally reported by the Sheriff to TICS, who will then DENY your purchase until it receives word that you were acquitted or the charges were dropped. The problem is that the court clerks rarely update TICS with the outcome in those cases. Something like 80% of the TICS denials are these false positives, where someone was arrested for assault and the case was dismissed.
