Reinstating the federal assault weapons ban that was in effect from 1994 to 2004 would prohibit manufacture and sales, but it would not affect weapons already possessed. This would leave millions of assault weapons in our communities for decades to come.
Instead, we should ban possession of military-style semiautomatic assault weapons, we should buy back such weapons from all who choose to abide by the law, and we should criminally prosecute any who choose to defy it by keeping their weapons. The ban would not apply to law enforcement agencies or shooting clubs.

  1. Anytime you see the word “buy back” you know you’re dealing with a criminal. There is no such thing. A sale involves a willing seller. If the seller isn’t willing, it’s confiscation, which is another word for robbery.

  5. I’m copying this from what I posted at the Hill. You should know just how smarmy this Eric Swalwell is:

    Eric Swalwell is entirely disingenuous and leaves out quite a few critical details in his story about Gary Jackson. Let’s explore what happened.

    In Oakland CA in 2009, Dreshawn Lee was spotted by Gary Jackson for carrying a sawed-off shotgun (which creating one in itself is a felony), and reported Lee to the authorities. Unfortunately, the Alameda County District Attorney’s office could not convict Lee of a crime, despite Jackson willing to testify against Lee. They cited “lack of evidence” to convict Lee of possession of an illegal short barrel shotgun. Because of this, Lee was set free, and then later extracted revenge and murdered Gary Jackson with an AK47.

    Who was working for the Alameda County District Attorney’s office at the time? Eric Swalwell. Because of the incompetence of the DA’s office — and possibly Swalwell himself, this violent criminal was let loose and murdered an innocent victim.

    What’s also remarkable of Swalwell’s call for a new “assault weapons” ban is that this crime happened in California, which at the time ALREADY HAD an assault weapon’s ban. Go figure that such bans are ineffective. Regardless of there being a ban, Lee was a 6-time convicted felon when he possessed the AK47. Felons are prohibited from possessing firearms of any kind. Imagine my shock to find out that a 6-time convicted felon didn’t obey a gun law.

    It takes a lot of cojones for Swalwell to go recommend laws that don’t even work in his own state, and for him to use the example of Jackson, whose murder Swalwell had indirect complicity in. This is why his calls ring hollow, and why it’s so disingenuous.

    1. His call makes perfect sense if you consider it as a way to protect his fellow criminals. It’s hard to be a robber if your intended victims can shoot back. Far better to disarm them first.
