ALBUQUERQUE, N.M. (KRQE) – Those who had their guns seized following a shooting at an Albuquerque protest can now get them back. Video shows a night in June when Steven Baca shot and wounded a demonstrator in Old Town at a protest over a conquistador statue.
Members of the militia group, The New Mexico Civil Guard, carrying their own guns, surround Baca after the shooting. Later, police confiscated those guns and held them as evidence in the case against Baca. Now, a judge has rules there has been enough time to examine them and they can be returned to their owners.
Judge rules guns seized at protest can be returned
You remember the case:
Steven Baca is waiting for trial because once again, proven retreat and self-defense via video is not evidence enough for a judge when politics are more important than Constitutional Rights.
Last I heard/read was that the police failed to secure both witnesses and some evidence of this case and that it may not be helpful on the prosecution of Baca. Anyway, at least a measure of justice has been achieved with the return of private property of its rightful owners.
And when they are returned they’ll be returned in very poor condition, I suspect most of them will be aesthetically damaged in some capacity while some have actual physical damage that require a gunsmith.
Maybe I’m getting to be overly cynical, but I would want to check for sabotage.
