On the book of face, I got into a debate w/ a hardcore anti-gun lefty who was jumping through hoops trying to defend the plea bargain for Hunter. He claimed it was perfectly fine since there was no ‘violent crime’ involved. When I asked why bother w/ the 10 year penalty then (never mind the recent bipartisan increase to 15 yrs), he blocked me.
yup. the whole 4473 is a farce. I say let that crackhead buy a gun, I’m fine with that – but just like everybody else, he better keep it pointed in a safe direction or things might end up, ummmm…. soupy….
I’m aware of pistol rights denied because of a years-old conviction for simple possession while a minor. In addition, a separate case for a octegenarian being denied involving a conviction for joyriding while a minor, before the GCA and this unconstitutional concept of “prohibited persons” even existed.
The low number of prosecutions is due to a combination of prior restraint and plea bargaining in exchange for tattling on the dealers.
4473 a farce? Sort of. Yes, if you think of it as what it pretends to be, a tool to keep guys out of bad hands. But it’s not a farce at all if you recognize it for what it really is: the input data stream for the gun registration database.
According to the Washington Post, in 2019 there were 478 referrals for lying on the 4473. Of these 298 were prosecuted. According to the ATF web page, in 2022 they referred 10,138 cases of any infraction for prosecution (with 15,583 defendants). Of these 6315 cases were prosecuted, with 5338 convictions (7293 defendants convicted).
Not drugs, but wasn’t there a straw buyer conviction appealed to SCOTUS and lost, where a cop used his Glock discount to buy a gun for his completely legal uncle? Don’t tell me innocent law abiding people are not thrown in prison by these laws.
Hunter’s attorney is going to challenge the constitutionality of the law. Please, Please, Please! I really hope he does, just so I can watch these politically partisan Democrat hacks in the media tie themselves in knots saying overturn this gun safety law we normally support and really want expanded into a defacto ban on gun purchases.
Imagine the internal conflict of all those gun banning liberal judges? My Gun Banning Principles? Or Party Loyalty, even if it is loyalty to a drug addicted pervert son of a corrupt senile disgrace to his office.
Further. – I think we should support them wholeheartedly if NAGR,SAF, FPC, and other gun rights organizations file as friends of the court supporting any attempt by Hunter’s lawyers to overturn the gun control laws.
