Holy shit this is a very bad bill.

H.R.5717 – Gun Violence Prevention and Community Safety Act of 2020

To end the epidemic of gun violence and build safer communities by strengthening Federal firearms laws and supporting gun violence research, intervention, and prevention initiatives.

It does some pretty terrible things:

Section 201: Universal Background Checks.

beginning on the date that the database is established under section 932(g), before completion of the transfer, the licensee verifies, using such database, that the purchaser has a valid—

“(i) Federal firearm owner’s license issued under section 932; or

“(ii) qualifying State firearm license, as described in section 932(d)(2), for the State in which the transfer will occur

Fast forward to 932:

§ 932. License to own firearms and ammunition

“(a) In General.—Except otherwise provided in this section, it shall be unlawful for any individual who is not licensed under this section to knowingly purchase, acquire, or possess a firearm or ammunition.

“(b) Eligibility.—An individual shall be eligible to receive a license under this section if the individual—

“(1) has attained 21 years of age; and

“(2) has completed training in firearms safety, including—

“(A) a written test, to demonstrate knowledge of applicable firearms laws;

“(B) hands-on testing, including firing testing, to demonstrate safe use of a firearm;

“(C) as part of the process for applying for such a license—

“(i) has submitted to a background investigation and criminal history check of the individual, including a background check using the National Instant Criminal Background Check System, to ensure the individual is not prohibited from possessing a firearm under subsection (g) or (n) of section 922; and

“(ii) has submitted a photograph of the individual;

“(D) has not been determined by a court, in accordance with subsection (c)(5), to be unsuitable to be issued a Federal firearm owner’s license; and

“(E) is not otherwise prohibited by Federal, State, Tribal, or local law from possessing a firearm.

This bill will require federal licensure for all guns and will raise the ownership age of all guns to 21.  This is a Federal ID.  It will expire every 10 years and will need to be renewed within 40 days of expiration.

Back to Universal background checks:

Beginning on the date that is 180 days after the date of enactment of the Gun Violence Prevention and Community Safety Act of 2020, it shall be unlawful for any person who is not a licensed importer, licensed manufacturer, or licensed dealer to transfer a firearm to any other person who is not so licensed, unless a licensed importer, licensed manufacturer, or licensed dealer has first taken possession of the firearm for the purpose of complying with subsection.

All transfers go through an FFL, except for immediate family and temporary transfers at approved shooting ranges.

Transfers at FFLs have a “not less than 7 business days” waiting period.  No maximum is specified.

The age for transfers of all guns and ammo is raised to 21, except for people hunting or shooting with family or as part of a job (military or ranching).

[Illegal] for any person to transfer, sell, trade, give, transport, or deliver any firearm or ammunition to any person who the transferor knows or has reasonable cause to believe is less than 21 years of age

Mandatory safe storage for all guns is required.  Unauthorized access means forfeiture of your guns.

Federal grants will be created for states to have Extreme Risk Protection Orders.  ERPOs will also be covered under Federal Court districts.

Bans assault weapons, suppressors, and stabilizing braces for pistols.  it also bans threaded barrels on any firearm that can take a detachable magazine.  Yes, that includes your handgun.

Magazine capacity is limited to 10 rounds, except for fixed tube mags for 22 LR rifles.

It gets worse:

Secure Storage Or Safety Device Requirement For Grandfathered Semiautomatic Assault Weapons.—It shall be unlawful for any person, other than a licensed importer, licensed manufacturer, or licensed dealer, to store or keep under the dominion or control of that person any grandfathered semiautomatic assault weapon that the person knows, or has reasonable cause to believe, will be accessible to an individual prohibited from receiving or possessing a firearm under subsection (g), (n), or (x), or any provision of State law, unless the grandfathered semiautomatic assault weapon is—

“(1) carried on the person, or within such close proximity that the person can readily retrieve and use the grandfathered semiautomatic assault weapon as if the grandfathered semiautomatic assault weapon were carried on the person; or

“(2) locked by a secure gun storage or safety device that the prohibited individual has no ability to access.”.

Mags must be marked:

Identification Markings For Large Capacity Ammunition Feeding Devices.—Section 923(i) of title 18, United States Code, as amended by this Act, is amended by adding at the end the following: “A large capacity ammunition feeding device manufactured after the date of enactment of the Gun Violence Prevention and Community Safety Act of 2020 shall be identified by a serial number and the date on which the device was manufactured or made, legibly and conspicuously engraved or cast on the device, and such other identification as the Attorney General shall by regulations prescribe.”.

Bans ghost guns, at home manufacturing, and putting a serial number on your gun without an FFL.

Bans purchase of more than one gun in any 30 day period.

The bill will also destroy the gun industry as it exists:

SEC. 802. REPEAL OF EXCLUSION OF PISTOLS, REVOLVERS, AND OTHER FIREARMS FROM CONSUMER PRODUCT SAFETY LAWS.

Sec 418 of the bill will impose a 30% tax on guns and a 50% tax on ammo.

That tax money will be weaponized against us.

(1) USE FOR GUN VIOLENCE PREVENTION AND RESEARCH.—An amount equal to 39 percent of revenues accruing from any tax imposed on shells and cartridges by section 4181 of the Internal Revenue Code of 1986, shall, subject to the exemptions in section 4182 of such title, be covered into the Community Violence Intervention Fund in the Treasury (hereinafter referred to as the “Fund”) and is authorized to be appropriated and made available until expended to carry out the purposes of paragraph (2).

(2) PROGRAMS FOR GUN VIOLENCE PREVENTION AND RESEARCH.—Amounts in the Fund established under paragraph (1) shall be used by the Secretary of Health and Human Services to carry out the program established under section 399V–7 of the Public Health Service Act (as added by section 901 of this Act).

They will use the money paid in taxes by law-abiding gun purchasers for anti-gun “research” and propaganda.

This bill is a horror show of gun bans, legal restrictions, regulations, and impositions that will destroy the ability of gun makers to continue operation.

I don’t think this has much shot of passing but given the way the Democrats have already tried to leverage the Coronacrisis, I won’t guarantee anything.  Not to mention that if they win in 2020, they might not copy/paste this to 2021.

The Left can never be allowed to win a majority ever again.

  3. It’s dead in the Senate, if not the House itself. The farthest of left are sponsoring it; it’s an election year; the sponsors are from the northeast except Johnson — and he’s just a lunatic.

    BTW, it only has 17 sponsors; Eleanor Norton is not a member of Congress.

    1. It’s the usual political game- sponsor a blue sky gun bill so one can tell their base that they are “standing up to the Eeeevil NRA Gun Lobby!”

      However, in light of the new mass panic gun buy, I suspect they will actually lose some votes in some areas.

      1. For some reason, Norton is allowed to sit in the chamber and I think she’s even allowed to speak, but she has no vote. Why she’s allowed in at all is a mystery to me; there is no constitutional authority for her presence.

  4. Ah, the usual traitors.
    This looks a lot like Senate Bill 2449 from last September (Booker & Blumenthal). I wrote a bunch of comments about it back then. The senate bill said that you had to get a separate license for each firearm. It also (like this one) says who is “eligible” to get a license, but it doesn’t say that if you’re eligible you will get a license. Perhaps it’s issued at the discretion of the powers that be. SB2449 said that each state would have license offices in both urban and rural locations — which suggests each state would have two offices, say one in Tallahassee and one in Felda.
    The “all transfers to go via FFL” may get some praise from dealers who think they can get some extra money that way. If you run into one, please post the name so we can add that name to our “never go there” list.
