The Democrats are OUTRAGED that that President-Oberfuhrer-Hitler-Nazi-Cheeto Trump is enforcing the law against one of their (the Dems) social justice protected classes, illegal immigrants.
Rational people can debate all day long the details and ethics of the zero-tolerance policy for illegal immigrants with children, and how many of the kids the media is saying are in ‘Trump’s concentration camps’ have been “ripped from their mother’s arms” and how many are unaccompanied minors and victims of trafficking. Those facts are important.
Senate and Congressional Democrats are not rational. Remember, this is the same group of people that staged an overnight sit in on the floor of the House over gun control.
This time around, they decided to “do something” and what they did was awful.

This is a bill with 100% Senate Democrat approval.
How bad can it be?
Democrats’ proposed legislation to prohibit so-called border separations would actually prevent federal law enforcement agencies almost anywhere inside the United States from arresting and detaining criminals who are parents having nothing to do with unlawfully crossing the border and seeking asylum.
Every Senate Democrat has now signed on to cosponsor a bill written so carelessly that it does not distinguish between migrant children at the border and U.S. citizen children already within the United States. The bill further does not distinguish between federal officers handling the border crisis and federal law enforcement pursuing the ordinary course of their duties.
That’s bad.
The proposed law would apply with equal force to, say, FBI agents (part of DOJ), Secret Service agents (part of DHS), and Centers for Disease Control officers (part of HHS) in the exercise of their everyday duties.
Third, “at or near the port of entry or within 100 miles of the border” does not meaningfully limit the geographic scope of this bill. That area includes almost the entirety of the geographical territory of the United States and the vast majority of people living in it. Two hundred million people live within 100 miles of the border. That’s roughly two-thirds of the U.S. population.
So what is the practical effect of this?
The ridiculous consequences of passing the Democrats’ hastily written mess are easily demonstrated. Let’s say FBI agents hear about a drug trafficker and murderer in Buffalo, New York. The agents get a warrant to raid the drug trafficker’s house and arrest him. While they do so, they discover the drug trafficker’s minor daughter is home with him. Feinstein’s bill would prohibit the FBI agents, while arresting a drug trafficker, from separating this child from her father.
This is not a farfetched hypothetical. FBI agents are agents of DOJ (a designated agency) and Buffalo is within 100 miles of the border. So long as the daughter is either a U.S. citizen or an alien without permanent status, the FBI agents would be unable to proceed with normal law enforcement activities. The agents would be forced to choose between booking the drug trafficking murderer into jail with his daughter or not booking him into jail at all.
So if the law is properly enforced, it would pretty much grind Federal law enforcement to a halt.
What the hell else did you expect.
The last time some Democrats “did something” legislatively that fast responding to a media circus that had not presented anywhere close to all the details, New York passed the NY SAFE Act.
Remember how bad the the NY SAFE Act was. It was written so hastily that it forgot to exempt police from the seven round magazine limit – back in 2013 when the Democrats still supported the police. Then important parts of the law, including the requirement about loading no more than seven rounds into an already capacity limited magazine had to be struck down by a Judge for being nearly impossible to enforce.
This is a terrible bill because “do something because CNN is running 24/7 hysterical coverage on it” results in terrible legislation.
Of course CNN won’t explain any of this, only that the GOP is a bunch of Nazi-Hitlers because they won’t support the Democrats’ bill to end Federal law enforcement.

How about this: FBI investigating child porn find that a father not only has child porn on his computer but is running a child sex trafficking ring. Because he lives in NYC (within the 100 mile zone), he can’t be separated from his victims.

“Port of entry” includes any “international airport” — which is defined as an airport where customs service is available (even if only upon request). So while “within 100 miles of the border” might seem fairly limiting, 100 miles of any port of entry would tend to cover most of the USA.
