Rep. Richard Hudson (R., N.C.) clarified on Wednesday that his national concealed carry reciprocity bill would apply to permits issued by states to non-residents. After Hudson introduced the Concealed Carry Reciprocity Act of 2017 last week, questions were raised about whether it would apply to permits issued by some states to non-residents. In an interview with the Free Beacon, Hudson confirmed that permits issued by any state to residents or non-residents would have to be recognized by all other states under his legislation.
“My legislative intent is to ensure a non-resident carry permit is recognized, and I’ve confirmed this with legislative counsel and Judiciary Committee staff,” Hudson said.

This is not only nuclear but terraforming. If passed, all the efforts by Michael Bloomberg to keep New York City “under control” (read, depending o the graces of the authority) will become sand in a hurricane. Same for Chicago and selected locations in California. Citizens of those places can get a CWP from Florida or Utah or wherever they issue out-of-state licenses and be able to defend themselves.
I am sure that the respective states will throw in some wrenches such as firearms identification cards like in Illinois and maybe some other restrictions that will need to be fought at state legislature and court level. But they Opposition does not have the impulse for that it once had.
Now, don’t get mad if the Non-Resident reciprocity gets tossed out and we get Plain Jane Reciprocity. Sometimes deals need to be made and we cannot let Perfect be the enemy of Damned Good. But keep fingers crossed for it anyway as it could be the crack in the dam for those Freedom-less states.
There will still be legal traps that are designed to ensnare legal carriers. Have hollow points in your firearm? Felony. Have a regular capacity mag? Felony. Carrying a gun with a red dot unless it’s on a full moon and the 4th Sunday in February? Felony.
Unfortunately, national reciprocity will be the start of a different kind of legal war.
Just let me carry in NJ. At this point, something is better than nothing. Getting our camel’s nose under their tent for once would be a fantastic thing.
Take your victories where you can find them and fight the abuses as and where they occur.
With all due respect — and thanks, don’t get me wrong — to Rep. Hudson, where in the bill does it explicitly say that non-resident permits must also be recognized?
Should the bill become law, and when it is challenged in court by anti-gun states, the first and foremost thing the courts will consider is what the law says. “Legislative intent” will be a factor, but a small one compared to the plain-text language. As we all should know by now, intent is not transferable.
If I were to bring a bill and my honest-to-God intent is to preserve public land access to ensure hunters can continue enjoying their pastime, but a line in my bill says that while the land is accessible, hunting is banned on it within the borders of my state, it doesn’t matter one iota what my intent was; the language overrides it.
If his intent is to make non-resident permits equally valid for the purposes of national reciprocity, I will want to see language in the bill clearly expressing that.
And yes, I know we may lose that portion but keep general national reciprocity (for resident permits only). It would still be a good bill and worth passing into law. My point is only that his intent can and will get thrown out the window if legislated push comes to litigated shove, so to me it’s an empty promise.
I think the most important part of carry reciprocity is getting people with permits into the states where legal carry has been effectively banned. The citizens of these states will realize that they do not cause, “OMG! Blood in the Streets! Wild West Shootouts!” and all the other gun control lies we have heard.
Permitted Carry passed in Minnesota and all the dire consequences never happened. A few years later, it passed in Wisconsin, and the streets again did not run red with blood.
When the citizens of NJ, Maryland and DC see that people with permits are not trouble, they will be able to change their own state laws. They will regain their rights again, Step by step, the same way we lost them, and then regained them.
Imagine the consternation in NYC if the NRA Convention is held in Manhattan and 50,000 people are carrying. Imagine the shock, when the biggest story is All Those Evil Guns, and Nothing Happened!
