This happened at Penn.

 

Every part of this interaction was a threat of violence.

“Don’t do something you’re going to regret” is absolutely a threat. There is no way to misinterpret that.

The strobe flashlight in his eyes and blocking his path was more than a threat, and was possibly assault. Especially when coupled with the statement, “I’m doing it for a reason. Get the message?”

“If you know what’s good for you, you’re gonna get the fuck out of here.” Said on a public college campus.

“I hope you have a good doctor. How’s your dental plan.” Obvious threatening statements.

I think that last statement might not be legally sufficient to draw a gun but I’m be damned tempted. And I definitely wouldn’t convict someone who shot in self-defense after hearing that.

I think back to my college days. I was a chemical engineer and I worked with a lot of pipe and valve in the lab.

I think I would start carrying a 12 or 15-inch adjustable wrench, along with a set of safety glasses, as school supplies for ChemE lab.

If a wrench needed to be deployed for other reasons in s pinch, I’m glad I had it on me.

  3. It’s two against one, and this is anything but peaceful. Remember that:
    – it isn’t required under self defense laws to let the other guy throw the first punch.
    – Florida, where I live, doesn’t require me to retreat in any place where I can lawfully be
    – Occupiers aren’t lawfully in the campus- they are unlawfully occupying it, so they don’t have the same claim to self defense
    – Let me quote the law to you- “A person is justified in using or threatening to use force, except deadly force, against another when and to the extent that the person reasonably believes that such conduct is necessary to defend himself or herself or another against the other’s imminent use of unlawful force. A person who uses or threatens to use force in accordance with this subsection does not have a duty to retreat before using or threatening to use such force.”
    – So if a pair of people tells me that I can’t enter a college where I am a student, and if i try, they will activate my health and dental insurance will immediately result in one getting a snoot full of pepper spray, and the other getting a full on ass whipping. A third assailant entering the fray would probably wind up looking down the barrel of a handgun, because three on one can make the case for imminent threat of serious bodily injury.

      However, with this being a college campus, I can only carry pepper spray and an expandable baton, but I still won’t back down.

      1. In Oregon, before the Legislature (in its infinite wisdom) changed the laws to outlaw carry at any school, someone with a CHL could legally carry on any public campus, be it a K-12 or public college or university campus. It might violate the student Code of Conduct, but it wasn’t illegal.

        So I’d be carrying anyway and keeping it well-concealed. And if anything did happen and the school tried to discipline me for violating the Code of Conduct, I’d be suing under the reasoning that the Code of Conduct is a contract: I’m required to agree to it to attend. Ergo, if I’m not allowed to carry defensive items, the university should be taking more action to keep the campus safe. I was assaulted by non-students the university allowed to remain indefinitely — despite multiple warnings from multiple parties that they were not students and would not remain “peaceful” — and therefore the university bears some liability for the fact I got assaulted at all.

        And to add to the effect, I’d be calling every news and media outlet I can find to share my story. Universities that coddle these “protesters” are losing endowments and alumni donations like crazy; let’s just accelerate that, shall we?

        1. As an afterthought, with so many alums distancing themselves from their alma maters because of this problem, and many employers saying they won’t hire applicants with degrees from those places:

          Has anyone researched the feasibility of starting an accredited “university”, with no teachers, faculty, or brick-and-mortar facilities, whose sole “business” is to transfer in degrees and credits from other schools and re-issue identical degrees under this school’s name? (For a nominal fee to cover accreditation and administrative costs.)

          Is your M.S. from UCLA or UPenn no longer respected because those schools have beclowned themselves on Woke political causes? Transfer your credits and degree to NBSU (No Bull-S#!t University) and we’ll issue you a new M.S. degree with none of the Woke baggage!

  4. Didn’t Larry Corriea write something about violence being a dimmer for the left, but a on/off switch for the right?

    They are trying to bait someone into using lethal force so they are justified in replying with lethal force themselves.
    .
    As you travel, remind yourself of that and do not take the bait.
