Getting punched is no simple thing.

It is dangerous and deadly serious.

Also, the fight isn’t over just because you think it is over, don’t let your guard down.

Texas dad left in coma after brutal attack while protecting daughter from boyfriend: cops

A Texas man is “fighting for his life” after an alleged brutal assault by his daughter’s boyfriend during an argument Saturday, according to reports.

Eric Garcia asked his daughter’s boyfriend to leave the home after overhearing him calling the girl derogatory names during an argument, reports said. His daughter had been dating the man for about a month.

Jamie Apodaca, 24, who police identified as the boyfriend, left and returned a few minutes later and began arguing with Garcia, reports said.

Eric Garcia remains in a coma at an Austin-area hospital, according to a GoFundMe page.

Apodaca, who had been staying with the family for 10 days, left and returned a few minutes later and began arguing with Garcia. The confrontation turned violent and police say Apodaca hit Garcia several times and punched his daughter, KEYE-TV reported.

At one point, Apodaca allegedly struck Garcia, causing him to fall and hit his head on the concrete, fracturing his skull.

“It was really shocking and it’s been a really tough couple of days, just kind of hoping that he pulls through but knowing that he probably won’t,” Garcia’s friend Rock Schouman told the station.

The father thought the fight, an argument at that point, was over when  Apodaca left.  Apodaca returned and escalated the fight to violence.

It was a bare fisted fight, but the father ended up in a coma from a head injury that very may well kill him.  If he does survive, he will end up with permanent brain damage and the long term debilitating effects of a TBI.

If you have to throw someone out of your house, make sure they cannot get back in.

If you think the fight is over but they don’t, be prepared for them to try and get revenge.

If someone tries to punch you, be prepared to defend yourself with lethal force.

If someone punches your daughter, shoot that motherfucker in the face with a goddamned shotgun, then sue his family for the cost of having to repaint and recarpet the room.

Miguel asked me to remind you about about disparity of force and that no, you probably don’t “have every right to use lethal force to defend yourself from someone using only their fists.”

This is found in FL 776.012(2)

Use or threatened use of force in defense of person.—
(1) A person is justified in using or threatening to use force, except deadly force, against another when and to the extent that the person reasonably believes that such conduct is necessary to defend himself or herself or another against the other’s imminent use of unlawful force. A person who uses or threatens to use force in accordance with this subsection does not have a duty to retreat before using or threatening to use such force.
(2) A person is justified in using or threatening to use deadly force if he or she reasonably believes that using or threatening to use such force is necessary to prevent imminent death or great bodily harm to himself or herself or another or to prevent the imminent commission of a forcible felony. A person who uses or threatens to use deadly force in accordance with this subsection does not have a duty to retreat and has the right to stand his or her ground if the person using or threatening to use the deadly force is not engaged in a criminal activity and is in a place where he or she has a right to be.

Always obey the law.

I will defer to Miguel as the senior amateur expert on these matters.

That said, I’m pretty sure ending up with a cracked skull and in a coma that nobody expects you to survive is sufficient enough evidence that the use of lethal force in defense was justified.

My previous post covered several incidents in New York City in which unarmed gang members put people in the hospital with brain injuries even though they were unarmed.

This is a law that needs to be changed.  If a grown man can throw a punch hard enough to cause coma or death, going up against a law abiding citizen with a gun should not be considered a disparity of force.

No one, I repeat no one, should die because he was to afraid to shoot a guy raining punches down on his head until brain injury occurs.

I would be happy to nullify any jury in which a CCW holder shot an assailant who was punching him in the head.
