Modesto police said Officer Thomas Miller with the Ceres Police Department was at Beyer Park around 10:30 at night with a woman. The park was closed at that hour. Investigators said 29-year-old Jason Moland confronted Miller with a BB gun and Miller responded with gunfire.
“We found an off-duty Ceres officer providing CPR to a man that had been shot on the ground,” Heather Graves, spokesperson for the Modesto Police Department,said.
Moland was transported to a nearby hospital where he died.

This happened in California where criminals are used to have unarmed citizens and therefore are basically walking ATM machines. And if you have any doubts, the following comment from the “victim’s” cousin is all the proof you need:
“What is an off-duty officer walking around with his gun for?” Tyrone Johnson, Moland’s cousin, wanted to know. “It just doesn’t make no sense to me.
“Criminals prefer unarmed victims” is not some vacuous slogan but a harsh reality.
I’ve said this before when discussing the rendering of First Aid after a self defense encounter (I’m an EMT and give away trauma shears regularly)…
Why the heck would you think that someone who just pointed a gun at you would suddenly change their mind and be grateful you were trying to help them? WTF? Can you be SURE they would not continue their assault? They could have another weapon, and if not, you would then be close enough for yours to be available to them.
You were just in fear of your life enough to respond with lethal force, and now you’ve changed your mind and are trying to help them? Think about this situation beforehand so you will already have a Plan on what to do. Then do it. Or in this case, don’t do it 🙂
The need for distance & cover don’t end when you THINK the fight ended. Also, Tiger McKee says “Following Victory, it’s best to reload”.
Its called.humanity , self defense then trying to remder assistance
I don’t think it’s called humanity after someone just tried to kill you. Actually I can’t think of anything to do with smart, either.
Would it make a difference if they had just physically hurt you?
If you just used LETHAL force, you had better have THOUGHT they intended you physical harm.

The reports say nothing about attempting to rob anybody so get ur damn story straight…when the truth comes out I want this bs as post to make a retraction…..
So he was walking around with a BB gun playing Aprils Fool? And if the report gets confirmed, will you return and apologize?
What does the word “confronted” mean to you? That the guy with the BB-gun walked up and said “I don’t care what you say, Daisy is better than Crossman any day”?
Or “Hey. mister, I can’t seem to hit the squirrels – can you check to see if the sights are boogered?”
