Two wounded students are taking their first steps to sue over the mass shooting at Stoneman Douglas High School in Parkland.
The law firm representing 15-year-old Kyle Laman sent a letter of its intent to sue the Broward Sheriff’s Office, the FBI, the Broward School Board and other defendants.
Kyle is the second student to file notice this week.
Separately, student survivor Anthony Borges, 15, and his parents notified Broward County Administrator Bertha Henry of their plan to sue. The notice claims negligence on the parts of Broward County Public Schools, Marjory Stoneman Douglas’ principal and its school resource officer.

We know that the lawsuit against BSO will go nowhere (No Duty To Protect), but it will be interesting to see how the School Board is gonna dance with this one.

Over at conservativetreehouse, there’s full documentation of the “promise program,” warnings given when it was first implemented that the ultimate result would be exactly what happened, and an offer to help with any suit related to injuries from the shooting. So far, what I’ve seen reported about the two suits looks like they’d fall to that “duty to protect” thing, but it looks plausible that a suit for willful negligence on the part of the county and the school district, based on the “promise program” might succeed.

    Then again, I’m an engineer, not an attorney, so I know a lot more about what makes sense, rather than the nuances of the law….
